Return and Refund Policy

Summary: You may withdraw from most online purchases within 14 days without giving a reason. Exceptions apply, in particular to perishable foods and sealed goods that are not suitable for return once unsealed. If you withdraw in time, we refund all payments including the cheapest standard delivery. You usually cover return postage unless the item is defective.

1. Right of Withdrawal (14 Days)

You have the right to withdraw from the contract within 14 days without giving any reason.

  • Start of the 14 days: for goods, the day you (or a non‑carrier third party named by you) take possession of the goods; for multiple consignments, when you receive the last item.
  • How to withdraw: send a clear statement (e.g., email or letter) that you withdraw. You may use the model form in Section 10, but it is not mandatory. It is sufficient to send your notice before the 14‑day period expires.

2. Exceptions (No Withdrawal Right)

The 14‑day right does not apply to:

  • Perishable goods that can spoil quickly or would quickly exceed their expiry date (e.g., fresh or chilled foods).
  • Sealed goods which are not suitable for return for reasons of health or hygiene once unsealed.
  • Goods made to your specifications or clearly personalised (e.g., custom hampers).
  • Goods inseparably mixed with other items after delivery; certain dated leisure services, etc. (as per §18 FAGG).

3. Refunds & Timing

If you withdraw, we will refund all payments we received from you, including the cost of the cheapest standard delivery we offer (not any premium shipping you selected). We use the same payment method and do not charge fees for the refund. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

Refund deadline: up to 14 days from receipt of your withdrawal notice (subject to the withhold rule above).

4. Returning Goods After Withdrawal

Please send back the goods within 14 days from notifying us of your withdrawal. You bear the direct costs of returning the goods unless we explicitly agree to cover them or the goods are defective/not as described. Pack items carefully; returned goods should be in the condition you received them.

5. Damaged, Defective or Incorrect Items

If a parcel is visibly damaged on delivery, you may refuse delivery (the carrier returns it to us), or accept it and document the damage (photos of the outer box, label and contents). For defective or not‑as‑described items, we cover the return costs and offer a replacement or refund.

6. Fresh, Chilled & Short‑Dated Products

Many of our items are perishable foods. For food‑safety reasons these products are often excluded from the 14‑day withdrawal once delivered in proper condition. Opened, unsealed, or temperature‑sensitive items generally cannot be returned unless defective or compromised on arrival.

7. Who Pays Shipping?

  • Outbound (original delivery): If you withdraw, we refund the product price plus our cheapest standard delivery (not express upgrades).
  • Return shipping: usually paid by you during the cooling‑off period, unless we failed to inform you beforehand or the goods are defective.

8. Statutory Warranty / Legal Guarantee

Your statutory rights remain unaffected. If goods are defective or not as described, you are entitled to repair, replacement, price reduction, or rescission under Austrian/EU rules (minimum two‑year legal guarantee for goods; specific rules apply).

9. How to Start a Return or Claim

  1. Email support@geschmackindia.at with your Order No., item(s), and reason (withdrawal or problem).
  2. We will confirm next steps and, if applicable, provide an RMA and a prepaid label for defective items.
  3. Pack securely and include the order/RMA note in the parcel.
  4. Keep the postage receipt/tracking. We process refunds within 14 days (we may wait until receipt or proof of dispatch).

For food safety, please do not return perishable goods without contacting us first.

11. Alternative Dispute Resolution (ADR)

We are not obliged and generally not willing to participate in consumer ADR before a specific body. Consumers may seek guidance from Austrian ADR entities (e.g., Internet‑Ombudsstelle, Schlichtung für Verbrauchergeschäfte). Note: the former EU Online Dispute Resolution platform was discontinued in July 2025.

12. Applicable Law & Scope

This policy follows Austrian law implementing the EU Consumer Rights Directive. Where EU rules are maximum‑harmonisation, member states apply substantially the same standards across the EU.
